Terms of Service

1. Acceptance of Terms

By creating an account or otherwise using Fortify Outreach Hub (the "Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. The Service

Fortify Outreach Hub is a SaaS platform that lets you import contact lists, connect your own sending mailboxes (Gmail via OAuth or SMTP), and run outbound email campaigns and follow-up sequences on your behalf. New Gmail connections are send-only; handle replies in Gmail and manually stop follow-ups or suppress bounced recipients in EOE. Legacy read-enabled connections may retain inbox polling as described in the Privacy Policy.

3. Accounts

You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately of any unauthorized use.

4. Acceptable Use

You agree not to use the Service to:

• Send unsolicited bulk email in violation of anti-spam laws including CAN-SPAM (US), CASL (Canada), GDPR / PECR (EU / UK), or any other applicable law.
• Send messages to recipients from whom you have no legitimate business relationship or lawful basis to contact.
• Send content that is unlawful, misleading, defamatory, infringing, harassing, or otherwise abusive.
• Violate the terms of your connected sending providers, including Google's Gmail Sending Limits and Bulk Sender Guidelines.
• Attempt to disrupt or reverse engineer the Service or circumvent security controls.

Campaign and sequence messages include an unsubscribe link; test messages do not necessarily include one. Recipients who use the unsubscribe link are suppressed across your account. You are responsible for honoring opt-outs received directly in Gmail.

5. Your Content

You retain ownership of the contacts, templates, and messages you upload. You grant us a limited license to host and process this content solely to operate the Service for you. You are responsible for having a lawful basis to contact the recipients you upload.

6. Connected Google Accounts

When you connect a Google account, you authorize the Service to send email on your behalf and identify your connected account. New connections do not request inbox-read permission. Legacy read grants may remain until you revoke them in Google Account settings. Deleting a mailbox in Email Accounts removes its stored credentials but does not revoke authorization at Google. A send already in progress may finish. No Google verification or approval is guaranteed.

7. Fees

Some features may require a paid subscription. Applicable fees are presented in the Service prior to purchase.

8. Termination

You may stop using the Service at any time. We may suspend or terminate accounts that violate these Terms or applicable law. Upon termination, we may delete your data after a reasonable retention period.

9. Disclaimer

The Service is provided "as is" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

To the maximum extent permitted by law, Fortify Outreach Hub will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill arising out of or related to the Service.

11. Changes

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
